1. Definitions
"Platform" refers to the HomeCraft website and services. "Client" refers to users seeking home services. "Service Provider" refers to companies or individual workers offering services through the Platform. "Order" refers to an agreement between Client and Service Provider. "Milestone" refers to a defined stage of work within an Order. "Escrow" refers to the system where Client payments are held until work is approved.
2. Platform Role and Liability
HomeCraft operates solely as an online marketplace that connects Clients with independent Service Providers.
- HomeCraft is NOT a contractor, construction company, design firm, or provider of any home services.
- HomeCraft does not employ, supervise, direct, or control any Service Provider. Service Providers are independent third parties.
- HomeCraft makes NO representations, warranties, or guarantees regarding: (a) the quality, safety, legality, or timeliness of any work performed; (b) the qualifications, licensing, insurance, or certifications of any Service Provider; (c) the accuracy of any portfolio, profile, or project information; (d) the outcome or result of any project.
- TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, HOMECRAFT EXPRESSLY DISCLAIMS ALL LIABILITY FOR ANY DIRECT, INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING FROM OR RELATED TO ANY SERVICES PROVIDED BY SERVICE PROVIDERS.
- You acknowledge that engaging a Service Provider through HomeCraft is at your own risk. HomeCraft shall have no liability for property damage, personal injury, project delays, cost overruns, or any other losses arising from the services.
3. User Accounts
You must provide accurate information when creating an account. You are responsible for maintaining the security of your account credentials. Service Providers must provide valid identification: a 9-digit Business Identification Number for companies or an 11-digit Personal ID for individual workers. All Service Provider accounts require approval before becoming active.
4. Service Provider Obligations
- Provide accurate, current, and non-misleading portfolio information, credentials, and profile details.
- Obtain all necessary licenses, permits, insurance, and authorizations required to perform services in compliance with Georgian law.
- Perform all work in a professional, workmanlike manner in accordance with applicable industry standards and agreed-upon specifications.
- Be solely responsible for tax obligations, including income tax, VAT, and social contributions as required by Georgian law.
5. Client Obligations
- Conduct your own due diligence before hiring any Service Provider, including verifying credentials, checking references, and confirming licensing requirements.
- Provide clear project specifications and requirements.
- Thoroughly review and verify all work BEFORE approving any Milestone. We strongly recommend on-site inspection of physical work prior to approval.
- Provide honest and accurate reviews based on your actual experience.
- Acknowledge that reviews and ratings on the Platform reflect subjective opinions and should not be the sole basis for hiring decisions.
6. Orders and Milestones
Orders are created by Service Providers and must be accepted by Clients. Each Order contains one or more Milestones representing stages of work. Milestones progress through the following statuses: Pending, In Progress, Submitted, Approved, and Paid. Clients should carefully review all Order terms before accepting.
7. Escrow and Payment Terms
The Escrow System is designed to protect both parties by holding Client payments until work is approved. However, the Escrow System does not guarantee the quality of work performed or eliminate all risks.
- Client payment obligations arise immediately upon Milestone Approval. By approving a Milestone, Client represents and warrants that they have thoroughly inspected and verified the work and are satisfied with the deliverables.
- MILESTONE APPROVAL IS FINAL AND IRREVERSIBLE. Once approved, payment will be released to the Service Provider and cannot be reversed, refunded, or disputed through the Platform, except as expressly provided in our Dispute Resolution process.
- The Platform charges a service fee (commission) that is deducted from payments before disbursement to Service Providers. Current commission rates are available on the Platform.
- Payments are processed through licensed payment processors (Bank of Georgia / TBC Bank) and are subject to their terms and conditions.
- Failure to respond to a Milestone submission within 30 days may result in automatic approval and payment release.
8. Refunds and Cancellations
- Pre-Approval: If work has not been approved, cancellation may be possible subject to negotiation between the parties.
- Post-Approval: Once a Milestone is approved, the payment is final. No refunds will be issued through the Platform.
- Platform-Initiated: HomeCraft reserves the right to cancel Orders in cases of fraud, violation of terms, or other exceptional circumstances.
9. Reviews and Ratings
Only Clients who have completed an Order can leave reviews. Reviews must be honest and based on actual experience. Prohibited content includes false statements, defamatory content, and personal attacks. HomeCraft reserves the right to remove reviews that violate these guidelines.
10. Dispute Resolution
HomeCraft's role in disputes is strictly limited to providing information to the parties and, at its sole discretion, facilitating communication. HomeCraft is not an arbitrator, mediator, or judge and will not make binding decisions in user disputes.
- Good Faith Negotiation: In the event of a dispute, the parties agree to first attempt good faith negotiation for a period of not less than 30 days.
- Binding Arbitration: Any dispute that cannot be resolved through negotiation shall be finally settled by binding arbitration administered in Tbilisi, Georgia, in accordance with Georgian arbitration law.
- Class Action Waiver: TO THE MAXIMUM EXTENT PERMITTED BY LAW, YOU AGREE TO RESOLVE DISPUTES ON AN INDIVIDUAL BASIS ONLY AND WAIVE ANY RIGHT TO PARTICIPATE IN CLASS ACTIONS OR CLASS-WIDE ARBITRATION.
11. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, HOMECRAFT'S TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT OF FEES PAID BY YOU TO THE PLATFORM IN THE 12 MONTHS PRECEDING THE CLAIM. IN NO EVENT SHALL HOMECRAFT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES.
12. Indemnification
You agree to indemnify, defend, and hold harmless HomeCraft, its officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses (including legal fees) arising from: (a) your use of the Platform; (b) your violation of these Terms; (c) your violation of any rights of third parties; (d) any services provided or received through the Platform.
13. Governing Law
These Terms shall be governed by and construed in accordance with the laws of Georgia. Any legal proceedings shall be conducted in the courts of Tbilisi, Georgia. The English version of these Terms shall prevail in case of any conflict with translations.
14. Changes to Terms
HomeCraft reserves the right to modify these Terms at any time. We will notify users of significant changes via email or platform notification. Your continued use of the Platform after changes take effect constitutes acceptance of the modified Terms.
